Local Government: Notes from the Town of Wawarsing Board Meeting

  • The Board unanimously voted to not provide Darlene Beiling of Creative Stages Daycare, Inc. with a new lease. The Town's refusal will require Ms. Beiling to move her business from its present location by the end of the year. The Town owns the building that houses the daycare center, making the Town Ms. Beiling's landlords. Ms. Beiling claims that she services over fifty area families with daycare on a regular basis. Town Supervisor James Dolaway offered his sympathies for what he said would be, "some tough decisions and sleepless nights – no doubt about it," as Ms. Beiling considers the future of her business.

  • The Board unanimously approved an agreement between itself and the Ellenville Central School District. The agreement had to do with allowing district school buses to fuel up at the Town's Highway Department stations.

  • The Board unanimously approved its most recent set of bills as audited.

  • The Board took no action as to whether to execute an agreement with the NYSDEC so that it could issue General Residential/Land Clearing Restricted Open Burning Permit for the Town of Wawarsing.

  • The Board unanimously approved the Ellenville Journal as an official newspaper of the Town of Wawarsing.

  • The Board unanimously approved the purchase of a 2007 Chevrolet Silverado 1500 Work Truck half-ton 4x4 Regular Cab Short Box for the price of $14, 880.00 plus Delivery Allowance Schedule for the Assessor's Department. This would be off a state bid contract.

  • The Board unanimously accepted the donation of a 1995 International Full-Sized School Bus to the Ellenville/Wawarsing Youth Commission by the First Student Transportation, Inc. of Wallkill, NY. The Bus will be used for the Youth Commission's field trips and programs.

  • The Board unanimously approved the addition of a new line item to the Highway-DB budget in the amount of $98,000. This will be for the payment on the lease for purchasing equipment for the Highway Department. The lease is a seven-year term between the Town and Chase Leasing Equipment and includes four trucks and a paving vehicle. The money was drawn from a $273,000 surplus from last year's budget.

  • At this point in the meeting's proceedings, Councilman John Gavaris offered a series of resolutions that would address concerns that he and other councilpersons had about Supervisor Dolaway's conduct of his position. The resolutions read as follows:

    1. A Resolution to Change the Procedure in Which a Resolution or Motion is brought up the Town Board during a meeting and in the manner in which a vote is called for.

    WHEREAS, the Supervisor has in the past refused to allow a resolution or motion to be brought forward and has prevented a resolution or motion from being made by a councilperson under their concerns portion of a Town Board meeting,

    It is hereby resolved that any Town Board member during a Town Board meeting may bring forward a resolution or make a motion and if a second of said resolution or motion is received and a vote of any such resolution and or motion, a vote of any such resolution or motion shall be made.  If a majority of the Town Board members vote in favor, then the resolution or motion shall be carried.

    Unanimously approved by the Board.


    2. A resolution requiring the Supervisor to notify the Town Board members of any meetings that the Supervisor has that have the potential of requiring action on the part of the Town Board.

    Whereas, The Supervisor in the past has had meetings that have had required action of the Town Board and where such meetings occurred without the knowledge of the Town Board,

    Upon motion duly made by Councilperson _______________ and seconded by Councilperson________________, it is hereby resolved that the Supervisor will notify the Town Board members by email and/or by telephone in advance of any meeting that the Supervisor has that may have the potential to require action on behalf of the Town Board, the Town Board shall be notified as soon as any such meeting is scheduled.

    Approved by a 4-1 margin (Dolaway)


    3. A Resolution prohibiting the Supervisor of the Town of Wawarsing from offering an opinion on behalf of the Town of Wawarsing or the Town Board without prior action of the Town Board

    WHEREAS, the Supervisor has in the past offered an opinion on behalf of the Town of Wawarsing and/or the Town Board without prior approval of the Town Board

    WHEREAS, the Supervisor has misrepresented the Town of Wawarsing's and/or the Town Board's opinion without prior discussion with the Town Board

    WHEREAS, it has come to the attention of members of the Town Board of the Town of Wawarsing that on occasion the Supervisor of the Town of Wawarsing has intimated to others that the TOWN has or has not taken certain action when in fact when said action has not come before the Town Board for a determination,

    Upon motion duly made by Councilperson _______________ and seconded by Councilperson________________, it is hereby resolved that the Supervisor shall not give an opinion whether written, verbal, or expressed in any way on behalf of the Town of Wawarsing or the Town Board without prior approval of the Town Board, be it further resolved that any opinion approved by the Town Board must be accurately relayed by the Supervisor.

    Approved by a 3-2 margin. (Dolaway and Geelan)
